General Background
The Office of the United Nations High Commissioner for Refugees was established on December 14, 1950 by the United Nations General Assembly. The agency is mandated to provide protection (including assistance) and seek durable solutions for millions of refugees around the world. In the People’s Republic of China, UNHCR registers and conducts refugee status determination for those seeking asylum, working to help refugees find solutions to their situations. UNHCR is involved with ensuring support for the protection of refugees and works with Government authorities to build domestic capacity. In addition, it has a specific mandate for the prevention and addressing situations of statelessness.
Operational Context
UNHCR’s official presence in the PRC dates back to 1979 to assist the Government with Indo-Chinese refugees. Since then, its work has centred on refugee status determination, assistance and seeking durable solutions for refugees. Despite being signatory to the 1951 Refugee Convention since 1982, China has no national asylum system. In the absence of asylum legislation and due to a lack of institutions and operating partners on the ground playing any protection role within the country, UNHCR delivers all core protection services through the operation of its mandate. The Government has expressed interest in incrementally taking over UNHCR’s responsibilities and UNHCR works with the Government authorities to build domestic capacity.
The Protection Associate is a member of the Protection team and reports to the Senior Protection Officer. S/he monitors protection standards, operational procedures and practices in protection delivery in line with international standards. The Protection Associate provides quality, timely and effective protection responses to the needs of populations of concern in China. S/he also ensures that persons of concern are involved with the Office in making decisions that affect them, whether in accessing their rights or in identifying appropriate solutions to their problems. To achieve this, the incumbent will need to build and maintain effective interfaces with local and central authorities, and communities of concern.
The Protection Associate assists in activities related to the processing of refugee claims in the operation. S/he may assist in compiling and analyzing information related to Refugee Status Determination (RSD) activities, conducting research related to RSD and maintaining the operation’s local repository of relevant information and guidelines, and drafting RSD Assessments.
In discharging these responsibilities, the Protection Associate liaises closely with other members of the Protection Team.
The ideal candidate should have knowledge in refugee protection and the ability to build constructive relationships with authorities. Training experience is an asset.
Recruitment as a UNHCR staff is subject to proof of vaccination against Covid-19.
Responsibility
Stay abreast of political, social, economic and cultural developments that have an impact on the protection environment.
Consistently apply International and National Law and applicable UN/UNHCR and IASC policy, standards and codes of conduct.
Assist in providing comments on existing and draft legislation related to PoC.
Provide advice on protection issues to PoC; liaise with competent authorities to ensure the issuance of personal and other relevant documentation.
Assist in conducting eligibility and status determination for PoC.
Contribute to measures to identify, prevent and reduce statelessness.
Contribute to a country-level child protection plan as part of the protection strategy.
Contribute to a country-level education plan as part of the protection strategy.
Monitor Standard Operating Procedures (SOPs) for all protection/solutions activities.
Manage individual protection cases including those on SGBV and child protection. Monitor, and intervene in cases of refoulement, expulsion and other protection incidents.
Assist in identifying durable solutions for the largest possible number of PoC through voluntary repatriation, local integration and where appropriate, resettlement.
Contribute to the design, implementation and evaluation of protection related AGD based programming with implementing and operational partners.
Facilitate effective information management through the provision of disaggregated data on PoC and their problems.
Participate in initiatives to capacitate authorities, relevant institutions and NGOs to strengthen national protection related legislation and procedures.
Assist the supervisor in prioritizing PoC for interview, counselling and propose protection support for individual cases.
Assist the supervisor with enforcing compliance of local implementing partners with global protection policies and standards of professional integrity in the delivery of protection services.
Assist the supervisor with enforcing compliance with, and integrity of, all protection standard operating procedures.
Submit individual payments request for PoC for approval.
Perform other related duties as required.
Essential Minimum Qualifications and Professional Experience Required
3 years relevant experience with High School Diploma; or 2 years relevant work experience with Bachelor or equivalent or higher.
Certificates and/or Licenses: International Law, Political Science or other related field.
Desirable: Protection Learning Programme
Fluency in English and working knowledge of another relevant UN language or local language
